In order to use certain features of the Service, you must register for an account. You may be asked to provide a password in connection with your account. You are entirely responsible for maintaining the confidentiality of your password and account. Furthermore, you are entirely responsible for any and all activities that occur on or through your account. You agree to notify BRAINSTORM immediately of any unauthorized use of your account or any other breach of security. BRAINSTORM will not be liable for any loss that you may incur as a result of someone else using your password or account, either with or without your knowledge. However, you could be held liable for losses incurred by BRAINSTORM or another party due to someone else using your account or password. You may not use anyone else’s account at any time without the permission of the account holder.
To help ensure the security of your password or account, please sign out of your account at the end of each session.
As between the parties, you own all right, title, and interest in and to the Content in your account, including all intellectual property and proprietary rights therein. Except as expressly set forth herein, BRAINSTORM acquires no right, title, or interest from you hereunder in or to your Content. “Content” means the data, information, images, and other content that is uploaded to, imported into or created in the Subscription Service by the Users, but does not include Statistical Data (as defined herein).
You hereby grant BRAINSTORM a worldwide, non-exclusive, non-transferable, right to access, use and process the Content: (a) as requested by you or a User; (b) as necessary to manage accounts, provide Support and provide and improve the Services, including to identify, investigate, or resolve technical or security problems with the Services and to detect and protect against fraud; and © as required by applicable law, regulation, legal process or enforceable governmental request and to detect and prevent violations of these Terms.
BRAINSTORM offers registered users a free trial of their platform alongside multiple tiers of paid plan options. The free trial is not time-limited and no credit card is required for signup to a free account.
Details of the fees for the paid plans can be found on Brainstorm’s website under “Prices” <insert link>. The prices stipulated there are binding and include the applicable value-added tax. All fees are due for payment immediately upon conclusion of the contract for the entire contract term.
BRAINSTORM reserves the right to modify pricing at any time for renewal terms; provided, that BRAINSTORM notifies you or the account admin prior to any price increase affecting that account. If you upgrade to a higher tier of paid account, BRAINSTORM will credit any remaining balance from your previous subscription payment to your new tier.
All payments due are in U.S. dollars unless otherwise indicated on the subscription pricing page, order, or invoice. Credit card, debit card, or other non-invoice forms of payment are due at the beginning of the relevant subscription term. BRAINSTORM will charge you for all fees when due. Brainstorm may enable other forms of payment on the Account Settings page, which may be subject to additional terms. Payments for invoices are due ten days after the invoice date, unless otherwise specified, and are considered delinquent thereafter.
Auto-renewal will be applied to all paid plan options at the end of their term. Your subscription will automatically renew at the end of each subscription term and you authorize BRAINSTORM to charge the credit card, debit card, or other non-invoice forms of payment for each renewal. If you wish to change your subscription tier, number of users, subscription term, or cancel your auto-renewal, the account owner or the admin must change the applicable settings in the Account Settings page provided in the Subscription Service or contact our customer support team prior to the renewal date.
Users may choose to terminate their subscription at any time. If you want to terminate your subscription and/or close your account, you may do so by emailing your request to [email protected], prior to the start of your next billing cycle. All termination or cancellation requests take effect at the end of the billing cycle during which they were submitted and no refunds are issued.
In addition, BRAINSTORM may terminate your subscription and/or close your account, for any or no reason, by providing you with written notice, to your email address on file thirty (30) days’ prior to closure and provide a pro-rata refund for any prepaid, unused subscription fees for the Services.
Either party may terminate the Services if: (a) the other party is in material breach of these Terms (or has acted in a manner which clearly shows that the party does not intend to, or is unable to comply with, the provisions of the Terms) and fails to cure such breach within ten (10) days following receipt of written notice from the non-breaching party (b) the other party ceases its business operations or becomes subject to insolvency proceedings and the proceedings are not dismissed within sixty (60) days; or © it is required to do so by law.

BRAINSTORM is not responsible for webcasting or any other form of transmission received from any linked site. BRAINSTORM is providing these links to you only as a convenience, and the inclusion of any link does not imply endorsement by BRAINSTORM of the site.
The Services that BRAINSTORM offers are designed to facilitate collaboration. It is possible for a user to post or submit a wide range of content to the Services (collectively, “Contributions”) and to collaborate with other users on BRAINSTORM containing such Contributions. Contributions may include, but are not limited to, photos, videos, text, drawings/sketches, Web content (including files or documents from third-party online storage services, notes from third-party note-taking applications, and links from third party websites), and other materials. Please be aware that you are entirely responsible for the content of, and any harm resulting from, any of your Contributions.
The price you pay for the BRAINSTORM Services protects Confidential Information, or non-public, proprietary, business, technical, security, legal, or financial information that is either marked or identified as Confidential Information or would reasonably be understood to be confidential, including information about products, processes, services, trade secrets, marketing and business plans, client lists, financial information, system architecture, security programs, and intellectual property. BRAINSTORM will not share any results that come out of BRAINSTORM sessions from paid subscribers. Results that are produced by free trial accounts can be shared on our website or other channels for marketing purposes.
Hate speech is not allowed on BRAINSTORM. We will remove content promoting violence or hatred against individuals or groups based on any of the following attributes:
